Club Tissus collects personal information when you purchase a product. When you go to the checkout page, we ask for information such as your name, address, telephone number, postal code, email address, and credit card information. Information may be recorded to help fulfill your requests for products, improve our services and contact you with the latest news and updates at Club Tissus. We do not share your personal information with others or nonaffiliated companies except to provide products or services you've requested.

It is strictly specified that the present conditions govern the sales of CLUB TISSUS and of all articles presented on this site. All products are sold new. These conditions apply to the exclusion of all other conditions, notably those in effect for in-store sales.

ARTICLE 1 – PRICE

1.1 Our prices for products will be indicated in Canadian dollars excluding taxes for shipping and handling (see shipping and handling conditions on CLUB TISSUS’ online store).

1.2 In the case of orders received outside of Canada, you will be the importer of all products concerned. For all products shipped outside of Canada, the billing price will automatically be calculated net of taxes. Customs duties, other local taxes, duties on imports or state taxes are likely to be applied. These duties and sums are not handled by CLUB TISSUS. They will be incurred by you and will be solely your responsibility in terms of declaration of payment to the qualified authorities and organizations of your country. We advise that you contact your local authorities for information on these aspects.

1.3 All orders regardless of origin will be paid for in Canadian dollars.

1.4 CLUB TISSUS reserves the right to modify its prices at all times, however all products will be billed according to their sale price at the moment the order is registered and available. All products remain the property of CLUB TISSUS until the sale price has been covered in full.

ARTICLE 2 – ORDER

By Internet: www.clubtissus.com. Contractual information will be presented in the French language and will be object to confirmation at the moment of delivery at the latest.

ARTICLE 3 – SUBMISSION

When you click on the submit button following the order process, you agree to the order as well as the importance of the current General Sales Conditions in their entirety and without objections. The data recorded by CLUB TISSUS constitute proof of transactions passed by CLUB TISSUS and its clients in their entirety. Data recorded by the payment system constitute the proof of financial transactions.

ARTICLE 4 – AVAILABILITY

Our products are offered within the limits of available stock. For out of stock products within our warehouses, our offers are valid within our suppliers’ availability. Within these constraints, indication of product availability will be given at the time your order is placed. This information is gained through our suppliers. Any errors or modifications are in independent of our will. In the case that the product is unavailable after your order is passed, you will be informed by mail as soon as possible. You will then by able to ask for a cancellation or exchange of your order.

ARTICLE 5 – DELIVERY

The products are delivered to the address you have indicated during the order process. The indicated delays are minimal delays and refer to the delays of processing and delivering products destined within Canada. In the case of varying delivery dates due to availability, the delay for delivery is based on the longest delay time. CLUB TISSUS reserves the possibility of splitting deliveries. Shipping and handling fees will only be billed for one delivery. In the case of uncommon delay time, you will be notified by mail.

ARTICLE 6 - PAYMENT

Payments of purchases will be done by credit card: Visa or MasterCard. Your credit card will be debited only at the time the product has been shipped.

ARTICLE 7 – SECURITY

Our site is maintained through a secure system: the transaction is insured through our partner ___________ who has implemented an encryption system securing the protection of any data revealed through payment processing. At no time on our website will we have access to your bank account.

ARTICLE 8 – SATISFACTION OR REIMBURSEMENT

8.1 Content on Reimbursement in Confidentiality Policy

8.2 You are entitled to a delay of fifteen (15) days upon receipt to return the product if it does not meet your needs. You thus incur the shipping expenses of sending and returning. Only the price of the product(s) bought will be reimbursed.

8.3 All products subject to sale by meter, patterns and foam mattresses cannot be returned. All articles returned incomplete, damaged or dirtied by the customer will not be accepted for return.

8.4 We commit ourselves to reimbursing you or exchanging the products that do not fit your order (defective or do not conform to). In this case we encourage you to make a detailed note of this on your purchase order and send us back your product(s). CLUB TISSUS will then proceed to the exchange or reimbursement of the product(s). In accordance with the statements in article 8.4, the shipping and handling fees will be reimbursed. However, the reimbursed amount will not exceed 1.5 times the amount billed for shipping.

8.5 Reimbursements will not exceed a delay of fifteen (15) days or less following the receipt of the product(s) in our care. Reimbursement shall be exercised by CLUB TISSUS choice of methods: either by crediting your credit card or by bank cheque addressed to the clients name and address appearing on the sales invoice.

ARTICLE 10 – INTELLECTUAL PROPERTY

All written texts, comments, works, illustrations and pictures reproduced CLUB TISSUS site are copy written and will follow intellectual property law worldwide. Only the private use under the laws governing intellectual property can be administered. Any other forbidden use of intellectual property on this site is subject to sanctions under the Intellectual property Act unless authorized by CLUB TISSUS. All full or partial reproduction of content on the CLUB TISSUS site is strictly forbidden.

ARTICLE 11 - RESPONSIBILITY

The proposed products conform to current Canadian legislation. CLUB TISSUS’s would not be liable in the event of disrespecting a country’s legislation where its products are delivered. It is your duty to verify with local authorities on the issues of import and use of these products/services you intend ordering. Pictures and content reproduced and illustrating the products on the site are not contractual. Consequently, CLUB TISSUS would not be liable in case of a picture or content error. CLUB TISSUS will not be held accountable in the event that the agreed contract cannot be executed in the case of an out-of-stock condition or unavailable product, of causes beyond control, of disturbance or all-out or partial strike of mail services and transport and/or communication methods, flood or fire. CLUB TISSUS will not incur any responsibility for all indirect damages aforementioned, material loss, profit loss, loss of chance, damage or expenses. CLUB TISSUS refrains from all responsibility in the case that the contents of these sites would contravene the legal and lawful provisions into force.

ARTICLE 12 – CAUSE BEYOND CONTROL

All engagements will be suspended in the case that an obligation cannot be carried out due to a cause beyond control. All severe events, not necessarily unforeseeable or irresistible, such as a strike within our establishments or those of our suppliers and distributors, floods, fires, theft, sabotages, etc.

ARTICLE 13 – NULLIFY

In the case that one of the clauses contained in these General Sales Conditions would be declared null, the validity of the other dispositions would remain unaffected.

ARTICLE 14- APPLICABLE DUTY LITIGATIONS

CLUB TISSUS refrains from revealing any personal information that is gained through its business with you. These remain confidential. They will not be used for any internal services but for the processing of your order or to reinforce and personalize the communication and offers reserved for CLUB TISSUS’s customers, notably for CLUB TISSUS newsletters that you have requested membership as well as within the constraints of personalizing the site to function within your core interests. The present article cannot prohibit the transfer nor the termination of activities to a third party.
